Merchant Street PSPO Extension -12/12/18

Decision type: Non-key

Decision status: For Determination

Notice of proposed decision first published: 26/11/2018

This decision will be taken under urgency procedures.

Reason for urgency:
The meeting is urgent and the business cannot be deferred as the current PSPO will expire on 31 January 2019 and the next Area Committee meeting is not scheduled until 20 March 2019, by which time it will be too late to propose an extension to the existing order and a new order will be required at significant ost to the Ciry Council. This item was not included in the 28 day notice due to a compliance error.

Anticipated restriction: Part exempt  - View reasons

Explanation of anticipated restriction:
“This appendix is exempt from publication under paragraph 5 and 7 of Schedule 12A to the Local Government Act 1972 because it contains legal advice relating to the Proposed Public Spaces Protection Order and, having regard to all the circumstances, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.
It is not in the public interest to disclose this information because this advice is professionally privileged and relates to potential proceedings which may arise from the proposed Order.”
