Arboretum, Hyson Green and Radford

Minutes:

David Scothern, Principal Enforcement Officer Community Protection, presented the report regarding the proposed extension of four Public Spaces Protection Orders.  He highlighted the following points:

 

a)  The Public Spaces Protection Orders (PSPOs) were originally Gating Orders that were subsequently converted to PSPOs following changes under the Anti-social Behaviour, Crime and Policing Act 2014.

 

b)  The Orders prohibit access to land as detailed in the respective Order and there are barriers in place at each entrance to the restricted areas to enforce the restrictions.

 

c)  PSPOs have a maximum term of three years but can be renewed.

 

d)  Consultation has taken place in relation to each of the proposed extensions.  All responses received have been in support of the proposed extensions.

 

During the subsequent discussion the following points were raised:

 

e)  There is a requirement that Orders should be reviewed periodically.  There is no formal review process in place other than in relation to the timetable for extension or discharge but they would be reviewed if concerns were raised during the intervening period.  There have been no concerns raised about the existing Orders for a considerable time.

 

f)  The barriers are checked periodically and the gates and signage currently appear to be in good order. 

 

g)  There was a limited response to the consultation which indicates a lack of concern about the proposed extensions.

 

h)  There is nothing to indicate that the existing Orders have transferred anti-social behaviour elsewhere and the problems have stopped.

 

i)  An Equality Impact Assessment has been carried out and officers have looked at the implications for some people of having to travel further than they otherwise might need to.  Residents at adjacent properties have been written to about the proposed extensions and no one has raised concerns in relation to this.

 

j)  If extended, the Orders will be advertised on the Council’s website and current signage will be updated.

 

 

Resolved

 

1)  that being satisfied that the test in Section 59 of the Anti-social Behaviour, Crime and Policing 2014 Act is met and having regard to the rights of freedom of expression and freedom of assembly, to extend the Nottingham City Council (Camomile Gardens, Radford, Nottingham) Gating Order 2008 (GO 5002) for a further three years from 19 October 2020 and authorise the Director of Community Protection to carry out the necessary advertisements and arrangements for appropriate signage to be erected where necessary in accordance with the legislative requirements;

 

2)  that being satisfied that the test in Section 59 of the Anti-social Behaviour, Crime and Policing 2014 Act is met and having regard to the rights of freedom of expression and freedom of assembly, to extend the Nottingham City Council (Holland Street, Arboretum, Nottingham) Gating Order 2014 (GO 5012) for a further three years from 19 October 2020 and authorise the Director of Community Protection to carry out the necessary advertisements and arrangements for appropriate signage to be erected where necessary in accordance with the legislative requirements;

 

3)  that being satisfied that the test in Section 59 of the Anti-social Behaviour, Crime and Policing 2014 Act is met and having regard to the rights of freedom of expression and freedom of assembly, to extend the Nottingham City Council (Hovenden Gardens, Hyson Green, Nottingham) Gating Order 2012 (GO 5010) for a further three years from 19 October 2020 and authorise the Director of Community Protection to carry out the necessary advertisements and arrangements for appropriate signage to be erected where necessary in accordance with the legislative requirements; and

 

4)  that being satisfied that the test in Section 59 of the Anti-social Behaviour, Crime and Policing 2014 Act is met and having regard to the rights of freedom of expression and freedom of assembly, to extend the Nottingham City Council (Portland Road, Arboretum, Nottingham) Gating Order 2012 (GO 5011) for a further three years from 19 October 2020 and authorise the Director of Community Protection to carry out the necessary advertisements and arrangements for appropriate signage to be erected where necessary in accordance with the legislative requirements.
