EXCLUSION OF THE PUBLIC

TO CONSIDER EXCLUDING THE PUBLIC FROM THE MEETING DURING CONSIDERATION OF THE REMAINING ITEM(S) IN ACCORDANCE WITH SECTION 100A(4) OF THE LOCAL GOVERNMENT ACT 1972 ON THE BASIS THAT, HAVING REGARD TO ALL THE CIRCUMSTANCES, THE PUBLIC INTEREST IN MAINTAINING THE EXEMPTION OUTWEIGHS THE PUBLIC INTEREST IN DISCLOSING THE INFORMATION

Minutes:

RESOLVED that, pursuant to section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the remaining item as it contained information relating to individuals and was likely to reveal the identity of those individuals and having regard to all the circumstances, the public interest in maintaining the exemption outweighed the public interest in disclosing the information, as defined in paragraphs 1, 2 and 3 of Schedule 12A to the Local Government Act 1972 (as amended).

The Committee considered the case presented by the Appellant and by the Management.

 

RESOLVED that the appeal be dismissed on the basis that the matter was one for consideration by the Pensions Ombudsman.

 

 

(1)  the Committee are disappointed that this mistake has occurred but note that an unreserved apology has been issued;

 

(2)  the Committee are unable to award any additional pension benefits but in any event note that no financial detriment, in terms of lost pension entitlement, has been suffered by the Appellant;

 

(3)  in the circumstances the appeal is dismissed on the basis that this is a matter for the Pensions Ombudsman.
