Report of Corporate Director of Commercial and Operations

Minutes:

The Committee considered a report of the Corporate Director of Commercial and Operations regarding an application for the renewal of a Sex Establishment Licence for the premises known as Private Shop, 81-85 Upper Parliament Street.

 

Mr Sullivan, Management Consultant and representative of Darker Enterprises Limited) presented the application, advised that there had been no objections to the renewal and invited questions from the Committee.

 

In response to questions from the Chair,

 

·  Mr Sullivan confirmed that the information given in answer to Question E3 on Appendix 2 to the report (whether Darker Enterprises Limited had ever had a Sex Establishment Licence application refused) ,related to  the company’s  former premises on Carrington Street.  Following refusal, Darker Enterprises Limited continued to run the Carrington Street shop selling articles which did not require a Sex Establishment Licence and subsequently those premises were granted a Sex Establishment Licence which was renewed.  The premises were affected by the proposed redevelopment and expansion of the Broadmarsh Centre which ultimately did not take place, and the company moved to its present location on Upper Parliament Street.  Mr Sullivan confirmed that Darker Enterprises Limited had never been refused a Sex Establishment Licence for its current site on Upper Parliament Street.

·  Mr. Mason confirmed that Darker Enterprises Limited kept a written record of refusals of service, and he estimated that such occurrences of refusals were rare, taking place once every 3 to 6 months.  He confirmed that if a customer appeared to be under the age of eighteen and could not prove their age by means of proof of identification, the customer would be refused entry to the premises.

 

 

 

RESOLVED to grant the renewal of the Sex Establishment Licence for the premises known as Private Shop, 81-85 Upper Parliament Street, subject to the Council’s standard conditions of licence and the existing special condition.
